Affiliate Program Terms and Conditions

Effective Date: June 2025

Thank you for your interest in becoming an affiliate for our commercial lending education course. These Terms and Conditions ("Agreement") govern your participation in our Affiliate Program ("Program"). By joining the Program, you agree to be bound by the following terms:

1. Eligibility

You must be 18 years of age or older to participate. We reserve the right to accept or reject any affiliate application at our sole discretion.

2. Commission and Payments

  • - Affiliates will earn 50% commission on all course sales generated through their unique affiliate link.
  • - Commission is calculated based on the net sale price, excluding taxes, refunds, or chargebacks.
  • - Commissions will be paid within 15 days of the end of each calendar month via PayPal.
  • - A valid tax identification number may be required prior to issuing any payments.

3. Referral Tracking and Attribution

  • - Each affiliate will receive a unique referral link.
  • - We use cookies and tracking software to identify and credit sales to the appropriate affiliate.
  • - Cookies are valid for 30 days from the userโ€™s first visit through the affiliate link.

4. Borrower Referral and Deal Participation

  • - If the affiliate is a lender, they may be given first opportunity to finance the loan.
  • - If the loan is placed through another lender, a referral fee may be paid to the affiliate, subject to applicable regulations and deal economics.

5. Promotion Guidelines

  • - Affiliates may promote the course through email, social media, podcast, blog, or other approved digital channels.
  • - Affiliates may not make false or misleading claims about the course or the company.
  • - No use of spam, unsolicited messaging, or paid advertising that misrepresents the brand.

6. Intellectual Property

All materials provided to you remain the property of The Investors Capital Group LLC. You may use approved logos, images, and content strictly for the purpose of promoting the Program.

7. Termination

We reserve the right to suspend or terminate your participation at any time for violation of these terms, suspected fraud, or any activity deemed harmful to our brand.

8. Modification

We reserve the right to update these terms at any time. Affiliates will be notified of changes via email or through their affiliate dashboard.

9. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages arising in connection with the Program. Our total liability shall not exceed the total commissions paid to you under this Agreement.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee without regard to its conflict of laws principles.

12. Prohibited Activities

  • - Use their own affiliate link to purchase the course (self-referrals are not allowed).
  • - Create websites, domains, or social media accounts that impersonate The Investors Capital Group LLC.
  • - Use unauthorized discounts, coupons, or incentive structures not approved in writing.

13. Refund Handling

In the event of a refunded purchase, any commission previously paid on that transaction may be deducted from future payouts or invoiced to the affiliate.

14. FTC Compliance

Affiliates must clearly disclose their affiliate relationship in all promotions, in compliance with the Federal Trade Commission (FTC) guidelines on endorsements and testimonials.

15. No Guarantee of Earnings

Participation in the Affiliate Program does not guarantee any income. Earnings will depend on your own marketing efforts and the quality of your referrals.

16. Independent Contractor Relationship

Affiliates are independent contractors and not employees, agents, or legal representatives of The Investors Capital Group LLC. Nothing in this Agreement shall create any partnership, joint venture, or employment relationship.
